Why, o why did I not copyright it??
It is your copyright and you are entitled to payment. You do not have to do anything to own the copyright. In law, the creator owns the copyright. That is absolutely categoric.
On the other hand, had the magazine come to you to ask permission to use it, as they should, would you have agreed without charging a fee?
Also, if Mudwiz gave them the pic and they assumed it was from him and asked permission to use it, although Ride is still technically in the wrong, it will probably sue Mudwiz for whatever damages you get. And so on....
If photography were your livelihood then having photos used without permission and payment would be important but most of us would be happy to to see our pics in print. I've asked a couple of guys on the site if I can send in their pics to a magazine. people should ask first but mistakenly think that if the pic is on the internet it is fair game and free to use.
One thing we could do is send Ride a letter about the infringement, saying while we imagine it was accidental and we're not necessarily going to demand money, it would be great if Ride could do a little piece about the site and our rideouts etc.
