    Cool section 59

    Hi be dam careful in N Wales boys. I just got myself a section 59 fo overtaking a plain blue volvo in Portmadog. The reason was given that I caused stress and anoyance to other road users (bull he didn't like me overtaking slow traffic) A section 59 is if you get another they impound and crush your bike. Another blunstron idea to get rid of bikes.There are also plain bikes aswell a red vfr800 is one. Not seen the others yet.SO BE WARNED SORRY WRONG AREA

    i've never heard of it

    Section 59 of the Police reform Act,

    Section 59 Police Reform Act 2002 states that -

    Where an officer has reasonable grounds for believing that a motor vehicle is being used in a manner which contravenes Road Traffic Act Section 3 (Careless Driving) OR Section 34 (Driving elsewhere than on a road) AND also the manner of use of the vehicle is causing or has been causing or is likely to cause, alarm distress or annoyance to members of the public, Section 59 can be used to:-
    initially give a written warning (valid for twelve months)
    (commonly called a Section 59 Notice)
    and on a subsequent occasion to seize the vehicle.
    (it will probably end up in the crusher, or may be ransomed back to the owner)
    A constable in uniform has the power to order the person driving to stop the vehicle, to seize and remove the vehicle, to enter any premises on which the officer has reasonable grounds for believing the motor vehicle to be and to use reasonable force. Seizure can made only if a warning has been given, or believed to have been given, or if a warning is clearly being ignored.
    So, usually it's a two-stage process - a warning or notice first, seizure if you persist or repeat.

    A section 59 is part of the public disorder bill section 5 is an £80 fine for things like swearing and loutish behavior. A section 59 is involving a motor vehicle, usually used when groups are racing one another in a residential area.
    YOU ONLY NEED TWO TOOLS IN LIFE - WD-40 AND DUCT TAPE. IF IT DOESN'T MOVE AND SHOULD, USE THE WD-40. IF IT SHOULDN'T MOVE AND DOES, USE THE DUCT TAPE

    This was the governments method to get the hooligans off minimotos from the estates, it just so happens its a good piece of legislation to be abused by pedants,in circumstances away from its origional intention,this allways happens with poor/rushed legislation.

    So you overtake an unmarked car stuck in traffic and they do you for causing stress and annoyance to other road users In that case we'd all get sect 59's every day of the week !!

    But your allowed to overtake slow moving traffic - even on white lines if the speed is slow enough???

    So what was their real problem?

    Are you going to challenge it?

    that'll be every set of traffic lights in the uk then

    what a load of bo**oks
    so i'm riding/driving down a road and come upon pedestrian pete and his motorised bath chair/invalid carriage which are becomming a frequent sight these days on the roads
    i overtake and the local boobby/revenue collector decides i've caused him him undue distress and issues a section 59
    all i can say is they can shove it up there area 51 and f*** off in big jerky movements

    Do you mean double white lines, rule 129 of the Highway codes states that you are allowed to cross double whites if:

    Double white lines where the line nearest you is solid. This means you MUST NOT cross or straddle it unless it is safe and you need to enter adjoining premises or a side road. You may cross the line if necessary, provided the road is clear, to pass a stationary vehicle, or overtake a pedal cycle, horse or road maintenance vehicle, if they are travelling at 10 mph (16 km/h) or less.

    When I did my training with the police I was told that they were the only vehicles you are allowed to cross a solid line for.

    Yep - so, you have a road sweeper in front doing 3 mph, theres 15 cars sitting behind it coz the first 2 cars wont/cant overtake - youre now in a que of traffic caused by a roadsweeper/maintenance vehicle - whooosh!!! Off you go
