    bl##dy fuming !!

hello all........may someone can help me out with this one. ( hoping some legal bods on here can enlighten me) where i live, we have shared public access out to street from back of house. now the idiot on the end has bought a scruffy mutt and has just informed me shes in the planning stage of putting up a side gate. the existing opening is approx 45" and me bike would need a min of 37" clearance ( tight) to get it through out to street. i have told her this and she cannot " guarantee" my bike will go through. is she entitled to do this regardless of my views. her overall view is if the bike wont fit.........tough sh#t. go and rent a garage ( at my expense of course) .not a happy soul at present. all suggestions ( apart from ramming it flat ) greatly appreciated halfway through building new ramp out back too, to get bikes into workshops to tinker on

"In planning gates that will close access to alleyways, there is a legal ‘duty of care’ to conduct a comprehensive consultation with all homeowners and residents who will be affected by the gates, and to secure written consent from them."

This is a quote from here:
    http://www.homeoffice.gov.uk/rds/prgpdfs/brf201.pdf

If she is restricting a right of access, she cannot do this without your written consent.

Why does she want a gate? Is she planning on turning the area into a dog toilet?

alan, thanks very much for your very helpful reply. i have no intention of giving any form of written consent until i have written assurance from her that the opening will not restrict my access with bike. with regards to the ` dog toilet `.....you must be physcic. hope we ain`t expected to drag wheelie bins etc through 2 foot deep dog sh#te. will really lose me rag then. thanks again mate for advice. appreciate it

alan is right, and if she is being a pain then let her build the gate (at her expense) illegally then you can have it removed

Even better I know a few v8 landrovers with winches on board that'll do a better removal job Only problem is that last time they removed more than ironwork... but they were kind enough to leave the bricks behind..
