    Filtering accident triumphant result at last!

    2 years ago I promised to update you on my accident when I was knocked off my Africa Twin whilst filtering by a driver who neglected to check his mirrors before turning right. It resulted in a badly broken leg and complicated ankle break for me preventing me from my work as a sports photographer. I am pleased to say that today I walked away from my barrister’s chambers with a very very successful compensation settlement. It took 2 long years and the hard work of Andrew Campbell, Motor Cycle News legal correspondent and highly regarded solicitor to get the justice this case deserved.
    Andrew has asked me to contribute to his column in MCN and I’m sure you'll be getting to hear the nitty gritty details in full in the press. For now I'd like to say a huge thanks to Andrew and his staff at Bike Lawyer.Co.Uk Bike Lawyer - Home . As for me I'm going to be heading out for a celebratory blat on my bike knowing there is justice in this crazy world so long as you get the decent team behind you!!

    Hi- Well done for the outcome...just read the 09 pages of build up- am I right in believing you settled on 60(him)-40(you)- how was this figure arrived at?- ...I am pleased you have got a favourable outcome, compensation wise,but I just can't see how the % was arrived at?

    If you could enlighten me, I would be grateful

    Congrat's Gnasher, nice to hear that your patience and your lawyer's expertise brought a good result at last. New bike? New kitchen? Any plans?

    Thanks Jem!! Your massages are certainly helping. I totally reccomend them to any weary bikers needing a bit of pampering. Florida will be the next stop I think! For now Im just happy all the shinnanigans are over and I can get on where I left off!

    Percentage wise was the only sticky bit because the driver had a passenger who colluded with his version of the events exaggerating my speed and positioning on the road. It was hard to argue my case with no witnesses available. We decided to get the hard part out of the way and go for the 60% fighting it up from the original 10% they were accepting. I have to say that I had I stayed with my original legal team who were assigned to me I'm pretty sure this case would have settled for 30% and nowhere near significant loss of both past and future earnings would have been recovered. I can't stress enough how important it is to know your rights and to know you are allowed seek out and choose the best legal representation available regardless if your insurance company badger you into using there own which they usually have financial motivation for using. If I had decided to fight for more than the 60% I could well still be fighting the liability issues in the courts. We decided that our efforts would be best spent proving the significant loss of earnings both past and future. Its cost me my old career and I have had to retrain in my new field as a film cameraman struggling to earn anywhere near what I earnt before. Iv'e a ton of people to thank in getting this result including all my old loyal customers who wrote my witness statements . It was almost like reading my obitury hearing people talk about what type of photographer I used to be and how I will be missed in the industry of extreme sports and sailing.
    Despite absorbing the 40 % I believe Andrew Campbell advised me in the best way and our efforts were better spent proving my very significant loss of earnings.
