    That case seems particularly similar to how it happened although there was enough space in front of her car and it was a wide road so she pulled straight out without any previous indication of a manoever. Read the highway code and it does appear to imply filtering is perfectly acceptable when carried out at a safe speed as this was.

    Cheers for the help guys, I'll let you know how it pans out. I think if liability is dumped 50:50 I'm going to put up a fight. Not a massive fan of insurance companies at the moment anyway. Glad I've found a good one finally (CIA)

    You should be ok...Filtering is considered a good thing to ease congestion as long as it is done safely and sensibly.

    I was filtering last september in creeping traffic doing about 20mph, and a women in a fiesta just pulled a u turn. I emergency stopped well enough that the bike missed her car, but my boot broke her bumper. Luckily for me, there was a bobby on the pavement who walked out into the road, and had some stern words with her, checked I was alright, and sent me on her way. I never did hear anything more but it was 100% her fault the bobby told me.

    On a side note, at least you do have the advantage of a witness.

    The only other time I did have a problem, I wasnt filtering...I was minding my own business doing about 30mph, when a car pulled out of a side road and drove into the side of my 125cc. She just shouted sorry and drove off...I didnt actually fall off....somehow I managed to control a 2 wheel drift enough to slow down to a stop (dont ask me how...I still dont know how I didnt fall off)
    I couldnt get her number plate and there were no witnesses either.
    It caused light damage to the bike (scratches, and a small crack in the side plastic), but caused more serious damage to my knee (on top of an old injury)...

    ok so after alot of messing about trying to find out who i should be speaking to and what i should be doing i think we are coming to a conclusion finally.

    the witness confirmed that she apologised and i decided to go through her insurance as i cant afford my excess. at first my insurance refused to help and hers refused to allow me to claim saying i did not have the proper authority. after alot of annoyance i contacted my solicitor who spoke to the other side who, infact accept full liability and are now arranging for my bike to be repaired and assessed. im intrigued now to see what the cost of damage is. glad its all coming together and there were no dispute over liabilities as i heard can happen on filtering incidents
