    can I claim from a pedestrian

    'If it can be shown that another party’s negligence has caused the accident, you should be eligible to claim'.

    Involved in an accident today both witnesses agree pedestrian was completely at fault, I is suspected he even tried to walk into me.

    Should I claim for cost of bike repair from him? If I go through insurer and it is proven not my fault will I lose my no claims?

    i did read a while ago about a female rider that had a woman walk out on her, bike leathers and helmet loads of damage and she had broken shoulder
    the woman traid to claim and she put in a counter claim, bike insurance waited till counter cliam settled before paying out
    lots of witnesses to the accident the rider sued the pedestrian and won, she could prove negligence on the womans part as she didnt look
    see a specialist no win no fee, as long as you have witnesses you should win

    First job is to fully assess the damage, mirror clamp bust, near side foot peg bust, damage to fairing, scratch screen, main worry is handle bars are to one side, I suspect they got bent when I hit the deck, I have the pray mat out it's not anything else. I'm off to see Richard Parret (bike wizrad) in the morning.

    My advice to all riders, FIT CRASH BARS, they really do make a big difference.

    Also off overland to Turkey on the 26th need to have a bike, I have the Transalp as a first reserve but it's asking alot of a wee 600cc bike. (I'm 20stone).

    In theory you can. But will they have any insurance? And if they don't, how much money will they be able to afford to pay?

    If you win and have an attachment to their earnings to pay you 30p a week for the next 400 years it will have been a fruitless effort.

    Did you call the police? I'd report it and give the witness details. If there is a crime there may be some way of getting money in compensation.
